Pop Shop Garage – Terms of Service & Liability Agreement

By accessing this website, booking an appointment, contacting us, dropping off a vehicle or item, paying an invoice, or requesting any service from Pop Shop Garage, you automatically agree to these Terms of Service and Liability Waiver. If you do not agree, you must not use our services.

1. Services Covered

These terms apply to all services provided by Pop Shop Garage, including:

• Performance upgrades, mechanical work, diagnostics, tuning, inspections
• Powder coating, sand blasting, paint stripping
• Ceramic coatings, vinyl wraps, tint, detailing
• 3D scanning, 3D modeling, 3D printing, fabrication
• All related or future services offered by the Shop

2. Assumption of Risk

By using our services, you acknowledge and accept that automotive repair, modification, fabrication, and cosmetic services involve inherent risks, including but not limited to:

• Mechanical or electrical failure
• Component stress, wear, or reduced reliability
• Cosmetic imperfections
• Exposure of hidden defects

You voluntarily accept all risks associated with work performed on your vehicle or property.

3. Pre-Existing Conditions & Mechanical Failure

Pop Shop Garage is not responsible for any pre-existing or hidden issues, including:

• Mechanical, electrical, structural, or cosmetic defects
• Failures discovered or worsened during service
• Issues caused by age, rust, prior work, or aftermarket parts

4. Customer-Supplied Parts

If you provide your own parts, you accept full responsibility for:

• Fitment, safety, performance, and compatibility
• Part failure or additional labor costs

The Shop provides no warranty on customer-supplied parts.

5. Vehicle & Property Storage Liability

Pop Shop Garage is not liable for damage, loss, or theft of vehicles or property while on or around our premises, regardless of cause, including:

• Theft, break-ins, vandalism
• Weather, hail, snow, wind, fire, or natural disasters
• Rodents, animals, or insects
• Third-party actions or other customers
• Damage during authorized test drives

Please remove valuables before drop-off.

6. Road Testing & Operation of Vehicles

You authorize Pop Shop Garage to operate your vehicle for diagnostic, testing, tuning, or quality-control purposes.

The Shop is not responsible for:

• Road hazards, debris, or weather conditions
• Mechanical failures during testing
• Damage caused by transport or towing companies

7. No Guarantee of Performance or Outcome

You understand and agree that:

• Performance gains are not guaranteed
• Completion times are estimates only
• Cosmetic finishes may vary
• Wraps, coatings, and powder coat may wear over time
• Modifications may void manufacturer warranties

8. Powder Coating, Blasting, Wraps & Finishing Work

You acknowledge that results may vary and that Pop Shop Garage is not responsible for:

• Warping, cracking, or structural changes exposed during processing
• Imperfections due to pre-existing material conditions
• Vinyl lifting, shrinking, or failure over time
• Coating longevity affected by environment or maintenance

9. Payment, Storage Fees & Abandoned Property

• Invoices must be paid in full before release of any vehicle or property
• Vehicles left more than 10 days after completion may incur storage fees
• After reasonable notice, abandoned vehicles may be subject to mechanic’s lien sale

10. Limitation of Liability

To the fullest extent permitted by Colorado law:

• The Shop’s liability is limited to the amount paid for that specific service
• The Shop is not liable for indirect, incidental, or consequential damages

11. Hold Harmless & Indemnification

By using our services, you agree to release, indemnify, and hold harmless Pops Tech LLC dba Pop Shop Garage from all claims, damages, injuries, or losses arising from:

• Work performed on your vehicle or property
• Mechanical or performance failures
• Customer-supplied parts
• Acts of God, theft, or third-party actions
• Use or operation of the vehicle after service

12. Governing Law

These terms are governed by the laws of the State of Colorado. All disputes must be resolved in El Paso County, Colorado.

13. Acceptance of Terms

You agree to be bound by these terms when you:

• Visit or use this website
• Schedule an appointment
• Drop off a vehicle or item
• Request or approve work
• Pay a deposit or invoice

Use of our services constitutes full acceptance of this Agreement.
